Terms & Conditions — Fraintesa & the Flowers
Fraintesa & the Flowers

Terms and Conditions

These terms govern every order placed on fraintesaandtheflowers.com. By completing an order you accept them.

1. The seller

&TheFlowers e.U., Hetzendorferstrasse 106-1, 1120 Vienna, Austria. VAT number (UID): ATU83752137. Contact: hello@fraintesaandtheflowers.com.

The studio address is not a public shop and is open by appointment only.

2. Products and prices

We sell the ceramic Flower Collar in three sizes: Small FCS (60 mm), Medium FCM (100 mm) and Large FCL (160 mm). Prices are € 28, € 44 and € 62. The complete set of three is € 110, a saving of € 24; the set price applies to one of each size only, and further units of the same size are charged at the normal price.

All prices are in euro and include Austrian VAT.

Prices include shipping within Austria and Italy, islands included. For all other destinations, shipping is calculated at the next step of the purchase before you confirm and pay.

3. How an order is concluded

Placing an order is an offer to buy. The contract comes into being when we send you the order confirmation by email. If we cannot make or send a piece, we tell you and refund you in full.

4. Payment

Payment is made through PayPal, which also accepts card payments without a PayPal account. Payment is taken when the order is placed.

5. Production and delivery

We give value to time. Every piece is produced and assembled after you order it, in a sustainable way, so there is no stock. Please do not expect your order to be dispatched the following day. If the piece you chose is ready, it is shipped promptly; if it has still to be made, production can take up to 14 days from the day you order. You receive an email as soon as your piece is shipped.

Parcels are sent with Österreichische Post AG. Delivery times after dispatch are those of the carrier and are outside our control.

6. Right of withdrawal

If you are a consumer in the EU, you may withdraw from the purchase within 14 days of receiving the parcel, without giving a reason. Write to hello@fraintesaandtheflowers.com within that period.

Return the piece in its original packaging, unused and undamaged. You carry the cost of the return shipment. We refund the purchase price, including the original standard shipping, within 14 days of receiving the piece back, using the same payment method.

Because our pieces are made to order but not personalised to your specification, the withdrawal right applies in full.

7. Faults and warranty

If a piece arrives broken or faulty, write to us within 48 hours of receiving the parcel, with a photograph, and we will replace it or refund you. Statutory warranty rights under Austrian law apply for two years.

Each piece is made by hand. Small irregularities in glaze, colour and edge are a characteristic of the work, not a fault, and are not grounds for a claim.

8. Care and handling

Do not open the box upside down. Slide the cover gently from the front side only.

The product is fragile. Handle it with care. Hand wash only.

We take no responsibility for damage caused by careless handling, or by washing with solutions other than the ones we suggest.

9. Packaging

The packaging is paper, 100% sustainable. The internal honeycomb is recycled and the external sleeve is made with recycled paper — Crush Mais by Favini, a paper mill in Italy.

Extra protective material may be added for safety. Please discard it in the correct bin so it stays in the recycling process.

10. Liability

We are liable for damage caused intentionally or by gross negligence. Liability for slight negligence is excluded, except for personal injury. Nothing in these terms limits a consumer's statutory rights.

Once the parcel has been delivered, the use, handling, cleaning and display of the product at home are the sole responsibility of the buyer. &TheFlowers e.U. is not liable for breakage, damage or injury caused by use that does not follow the care instructions in section 8, including dropping, impact, dishwasher cleaning, or cleaning with products other than those we recommend. This also covers swallowing the product or any part of it, and injury from sharp fragments after a piece has broken. The product is not a toy: keep it, and any broken pieces, out of reach of children and pets, and dispose of fragments carefully.

This does not limit your statutory warranty rights, our liability under the Austrian Product Liability Act, or our liability for personal injury.

11. Applicable law

Austrian law applies. For consumers, this does not affect the protection of the mandatory consumer law of the country where you live. Place of jurisdiction is Vienna, unless consumer law provides otherwise.

12. Online dispute resolution

We are not obliged, and are not willing, to take part in dispute resolution before a consumer arbitration board.

13. Changes

The terms in force are those published on this page at the time of your order.
